ARTICLE 1: SCOPE AND CHANGE OF TERMS AND CONDITIONS OF SALE

1.1: General

These terms and conditions of sale apply to all orders placed on the online store www.nicecollection.online referred to below as "Nicecollection" or "seller".

The seller reserves the option to adapt or modify these terms and conditions of sale at any time. In the event of a change, the general terms and conditions of sale in effect on the day of the order will be applied to each order.

1.3: Access to the Site

The buyer connects by his own computer and telecommunications means allowing access to the online shop www.nicecollection.online.

The buyer retains the cost of telecommunications when accessing the Internet and using the site.

ARTICLE 2 - PRICE

The selling prices of the products online on the NiceCollection shop, shown in euros on the purchaser's purchase order.

They do not include shipping costs, charged in addition to the price of products purchased according to the amount of the order. Shipping costs will be shown before the seller registers the order.

The seller reserves the right to change his prices at any time.

In the event of an order to a country other than metropolitan France, customs duties or other local taxes may be payable. These rights and sums are not within the seller's purview. They will be the responsibility of the customer and are fully responsible in terms of both declaration and payment to the competent authorities of the country of delivery. These aspects should therefore be investigated with the relevant local authorities.

ARTICLE 3 - ITEM AVAILABILITY AND CHOICE

The buyer can pre-order, read on the Online store NiceCollection of the essential characteristics of the items he wants to order.

The buyer selects one or more items from the different categories on offer.

The buyer who has become aware of the items and their characteristics has under his sole responsibility, and according to his needs as he has previously determined them before any order, has made his choice on the item or items that are the subject of his order.

Most of the items on offer are made by the seller. Items are therefore customized and pre-ordered.

Delivery times are therefore one to four weeks. Availability is indicated for informational purposes and without the seller's commitment when your order is placed. It indicates that the ordered item can be carried out.

If items are found to be unavailable after the buyer's transfer, the buyer will be notified by email or phone as soon as possible. Cancel or exchange your order according to the customer's wishes.

Photographs, graphics and descriptions of the items offered for sale are only indicative and do not engage the seller.

The photographs, graphics describing the articles are the full property of NiceCollection.

No image may be used or exploited for commercial purposes.

ARTICLE 4 - ORDERS

Any order requires unrestricted or unqualified adherence to these terms and conditions of sale. The ordering process involves several steps, from selection to final validation. At the end of this process and just before the confirmation of the order, the buyer will have to validate by checking the sentence "Acceptance of the terms and conditions of sale".

From the moment the buyer has checked this box and confirmed his order, he is considered to have knowingly and unreservedly accepted the present terms and conditions of sale, prices, volumes and quantities of the products offered for sale and ordered.

The sale will only be considered final after NicecCollection sends the confirmation of the order to the buyer and the full amount is collected.

The seller reserves the right to refuse any order from a customer with whom there is a dispute over the payment of a previous order.

The information stated by the buyer, when taking the order, commits the buyer: in the event of an error in the wording of the recipient's contact information, the seller cannot be held responsible for the impossibility in which it might be to deliver the product. In the event of an incorrect address provided by the buyer, the cost of returning the order will then be borne by the buyer.

ARTICLE 5 - PAYMENT

The payment of the entire price must be made when ordered by the buyer.

The cashing of the entire amount of the order will be made by the seller at the time of validation of the order or in case of payment by cheque when it is received.

All orders are payable in Euros.

Payments can be executed:

- by credit card,

- by electronic payment PayPal,

- by bank transfer (European transfer IBAN BIC),

- by bank or postal cheque (issued by a bank domiciled in metropolitan France),

- cash (except above the legal amount) in case of hand-handing.

The seller reserves the right to request a bank cheque from the buyer in the event that the sums incurred are significant.

The buyer assures NiceCollection that he has the necessary permissions to use the payment method he has chosen when registering the purchase order.

Delivery of any new order may be suspended in the event of a notification of payment rejection for any other means of payment of a previous order.

When the buyer is late in payment, the seller can the seller alone and without the need for a prior notice, immediately suspend deliveries, without the buyer being able to claim damages from the seller. In the event of a litigation, the seller is entitled to claim reimbursement from the buyer for any costs of any kind related to the lawsuit. No settlement paid to NiceCollection can be considered a deposit.

As part of the fight against Internet fraud, information about your order can be passed on to any third party for verification.

ARTICLE 6 - DELIVERY

1.1: General

Items are delivered to the delivery address that you will have indicated when you order. Delivery includes the item or items ordered. The detailed invoice is sent by email or in paper format in case of absence of email.

The average delivery time is between 2 and 10 working days and depends on the carrier.

The time frames indicated are average deadlines and correspond to the processing and delivery times for items destined for metropolitan France and Corsica. They are not deadlines for rigour. NiceCollection will not be liable for delivery delays or stock outages.

In any event, and in accordance with the provisions of Article L 121.20.3 of the Consumer Code, the ordered items will be delivered within a maximum of thirty days from the day after the buyer registered his order, subject to the full payment of the price.

If delivery is not completed at the end of this period, the buyer will have the option to cancel his order. The sums paid by the buyer will then be returned to him without delay, to the exclusion of any other compensation.

In the event of a delay in delivery from the original date, the buyer will have to report it in writing (phone, mail, email) to the seller in order to improve the quality of service that may be offered to him and to allow Nicecollection to carry out an investigation with the carrier.

A survey with the carrier can take up to 21 business days. If during this time the parcel is found, it will be immediately re-routed to the designated delivery location at the time of the initial order.

On the other hand, if the parcel is not found at the end of this 21-day investigation period, the seller will re-ship the items ordered by the buyer at his own expense.

If the ordered item or items are no longer available, the buyer will be informed as soon as possible. A delivery period will be communicated to the buyer who can then accept the terms or request the refund of the affected items without delay and no later than thirty days of payment of the sums he has paid.

In the event of a product exchange, the delivery costs will be borne by the consumer.

The buyer may, at his express request, obtain the invoice to the billing address and not to the delivery address by specifying it in the "Note" field on the purchase order.

If the items are partially available, the seller may have to split the orders. So the available items can be sent in the first place, the balance of the order will be sent when all the other items are available.

In the absence of respect for the procedures outlined below, no buyer's claim will be accepted.

1.2: Special cases

- Wrong delivery addresses and return under the NPAI motive

The parcels are delivered to the so-called "delivery address" address. This address is mentioned and entered by the buyer when registering the order.

In the event of an incorrect address provided by the buyer, the cost of returning the order will then be borne by the buyer. The parcel will then be sent again once the buyer has paid the new shipping costs generated.

- Unclaimed parcels at the Post Office

For shipments in recommended or colissimo with signature, in the absence of the recipient at the time of delivery, the Post Office files a notice of passage stating that the parcel is available for 15 days at its post office. If the parcel is not removed within the allotted time, the package is returned to the seller. In this case NiceCollection will charge the buyer for the new one the delivery fee for his order if the buyer has requested the re-shipment.

- Refused parcels

If the package is damaged, torn, opened... It is imperative to refuse the package and contact the seller in order to inform him. If the supplier responsible for delivering your parcel is the Post Office, you must request a declaration of looting at the time of the refusal.

After receiving and accepting the package, depending on the nature of the product, the stocks available and according to your wish, I would propose to re-export the product originally ordered or an exchange product with equivalent characteristics.

ARTICLE 7 - RETRACTION, RETURN AND REFUND

In accordance with Section L.121-20 and following of the Consumer Code, the buyer has 7 (seven) working days from the date of receipt of your parcel, to return any unsuitable items, in its original packaging and in good condition, suitable for its re-marketing and request the exchange or refund without penalty, except for the return fee. The buyer therefore has 7 days to report his retraction.

Any returned items must be returned to the address mentioned in Article 1 and accompanied by a copy of the delivery voucher or invoice with a reference to the reason for the return.

WARNING: No retraction will be accepted if the returned product is unsuitable for re-marketing.

Therefore:

- The product must be returned in perfect condition, undamaged, unmarked....

- The product must be accompanied by all its accessories,

Otherwise, the product will be returned to you, at your expense and no refund or exchange will be granted.

After receiving and accepting your returned package, depending on the nature of the product, the stocks available and as desired, the seller will propose a re-shipment of an exchange product of equivalent value.

Otherwise, a refund or voucher will be offered. It will match the amount of items returned.

If you have chosen to be reimbursed (a must-pay on your return), within 15 days of accepting your return, a refund will be made in the form of a bank cheque, electronic refund PayPal or bank transfer.

ARTICLE 8 - PROPERTY RESERVE

The products remain the property of the seller until the full payment of the price.

ARTICLE 9 - INTELLECTUAL PROPERTY

All the elements reproduced on this site (logos, photographs, products, texts, graphic charter...) protected by the intellectual property code and the civil code belong to the seller. Therefore, none of these items can be represented, downloaded, reproduced, transmitted, translated, sold, commercially exploited or for free or reused in any way without the seller's prior consent.

ARTICLE 10 - Responsibility

10.1: The seller cannot be held responsible for any damage of any kind, whether material, immaterial or bodily, that could result from the misuse of the items sold.

10.2: Photographs and texts reproduced and illustrating the products presented are not contractual. The seller cannot be liable if there is an error in any of these photographs or texts.

10.3: The seller cannot be held responsible for the non-performance of the contract concluded in the event of a stock outage or unavailability of the product and force majeure. The force majeure includes all cases recognized by the case law and any malfunction of the Internet network, the disruption or total or partial strike including postal services and means of transport and/or communications, flood, fire ...

10.4: The seller cannot be responsible for any data loss, files. It is up to the buyer to make all necessary backups.

10.5: The total or partial impossibility of using the products cannot incur niceCollection's liability or give rise to any compensation or refund.

10.6: The NiceCollection online store also contains information from third parties, and links to other websites. He cannot be held responsible for the damage resulting from the use of access, or for the inability to use this third-party information, or for the content of other websites.

ARTICLE 11 - PERSONAL INFORMATION

Concerned about protecting your privacy, NiceCollection treats all customer information with the strictest confidentiality. The information requested is essential (name, first names, address, email, phone) for quality processing and careful monitoring of orders. This information is reserved exclusively for NiceCollection.

In accordance with the Computer science and Freedoms Act of January 6, 1978, the buyer has a right of access, rectification, and opposition to personal data concerning him. All you need to do is ask us online or by mail with your name, first names and address.
